Claims Against Financial Advisors

Contact-Us

Good & Murray Smith LLP have acted in hundreds of professional negligence claims against financial advisors, with values ranging from tens of thousands to several million euro. We deal with these disputes every day. They are unique in that they often require an understanding of a complex regulatory regime, which many solicitors do not have.

Who We Act for in Financial Advisor Negligence Claims

We work with clients from a wide range of backgrounds, including:

  • Consumers, including private investors, retirees, directors, business owners and people who were advised on pensions, savings, lump sums or inheritance proceeds.
  • Businesses, such as SMEs, larger companies, funds, professional practices and organisations that relied on financial advice in relation to investments, corporate structures, employee schemes or treasury decisions.
  • Cross-border clients, such as overseas investors instructing Irish financial advisors.

Our Approach to Claims Against Financial Advisors

Our approach is guided by efficiency and outcome.

Case Assessment

We try to understand your situation fully. We look at the documents you have, the advice you were given, the decisions you made based on that advice and the financial impact you are now facing. This allows us to give you a sense of the strengths of your potential claim, the risks involved and whether pursuing it is realistic and proportionate.

Pre-action Correspondence and Negotiation

If you are happy to proceed, we prepare a letter of claim setting out the outcome you are seeking. We handle all communication with the advisor or their insurer, including their initial responses and any follow-up queries. If there is an opportunity to resolve the matter without going to court, we explore it with you. Settlement discussions, without prejudice meetings and mediation can all play a part in reaching a practical, early resolution.

Litigation

Many claims cannot be resolved through correspondence or negotiation. If that happens, we prepare the claim, issue the proceedings and manage the case from start to finish. This includes working with specialist barristers and gathering expert evidence.
